This Privacy Policy (the “Policy”) governs your use of our Website and application (together, the “Service”). It sets out the categories of data we collect, how we store it, how it may be used, with whom it may be shared and the choices you have in relation to those uses and disclosures. It also describes certain legal rights you may have, subject to applicable law, and how you can exercise them.
Please read this Policy in full before using the Service.
What the words in this Policy mean
“personal information” and “personal data” mean data about identified or identifiable individuals, such as a name, mobile phone number or email address. Where applicable law gives the term a wider meaning, including under relevant U.S. federal or state legislation or under the law of the European Union, that wider meaning applies.
“GDPR” means the General Data Protection Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
“EEA” means the European Economic Area, which includes all Member States of the European Union together with Iceland, Liechtenstein and Norway. References in this Policy to the EEA also cover the United Kingdom of Great Britain and Northern Ireland, and references to the GDPR also cover the UK GDPR as it applies there.
“Process”, in respect of personal data, means to collect, store, use and disclose it to others.
“Controller” means the person or organisation that decides why and how your personal data is processed.
Terms not defined in this Policy have the meaning given to them in the GDPR, unless stated otherwise. For the meaning of capitalised words that are not defined here, please see our Terms of Service.
Any translation of this Policy is provided for your convenience only. In the event of a difference in meaning or interpretation between the English version and a translation, the English version prevails and is the sole legally binding text.
1. Who controls your data
Lerulya Limited is the controller of your personal data.
If you have any question about this Policy or about how we handle your data, you can reach us at support@roohy.com.
2. The data we hold about you
We collect data that you make available to us voluntarily, for example your email address, phone number, name and date of birth. We also collect data automatically when you use the Service, for example your IP address and device type.
2.1. What you give us
You provide us with data about yourself when you register for or use the Service, for example when you create a user profile (“Profile”), reply to our emails or report a problem. That data includes the following.
| Category of data | What it includes |
|---|---|
Profile data and other materials you post on the Service | This includes your name, username, date of birth and email address. You may also provide your phone number, voice and image in any content you upload, and further data on your Profile. That may include your gender and age, other personal characteristics and demographic data, any ideas, comments and testimonials you share and post, as well as images, photographs and videos. |
Memory photos | If you use the Memories feature, we collect the photos you take or upload after a practice and any captions you add. These photos may show you or, if you use a kids plan, your child. |
Onboarding data | When you complete our onboarding questionnaire, we collect the answers you give us and, where they include health-related information such as physical parameters or limitations, that information as well. We use those answers to create and adjust the practices and plans shown to you. |
Communications with us | When you contact our support team, we collect the content of your message, your contact details and anything else you choose to include in it. |
2.2. What we pick up as you use the Service
| Category of data | What it includes |
|---|---|
Cookies and similar technologies | Our Service uses cookies that record data about the use of our Service in order to distinguish you from other users. You can control cookies through your browser settings. Section 14 explains how we use cookies and how to manage them. |
Data about how you found us | We collect data about your referring URL, that is, the place on the web where you were when you tapped on our ad. |
Software development kits (SDKs) | In our mobile application we may also use software development kits (SDKs). SDKs help us understand how you interact with our applications and collect certain information about the device and the network you use to access them. For example, we may use the Smartlook SDK, a third-party analytics and session-recording service, to help us improve the performance and usability of the Service. Smartlook may collect information about how you interact with our application or website, including screen views, taps, gestures, session durations, device information such as device model, operating system version and app version, and diagnostic data such as crashes or errors. The information collected is used for internal analytics purposes only, helping us understand feature usage, detect issues and improve the user experience. We have configured our SDKs so that they do not capture sensitive personal data. |
Browser and device data | We collect data from and about the devices you use to access the Service, depending on the permissions you have granted. We may associate data collected from your different devices, which helps us provide a consistent service across them. Examples include language settings, IP address, location, time zone, type and model of device, device settings, operating system, Internet service provider, mobile carrier, hardware ID and Facebook ID. We also collect your Apple Identifier for Advertising (“IDFA”) or your Google Advertising ID (“AAID”), depending on the operating system of your device. You can usually reset these identifiers in the settings of your device’s operating system, although we do not control that process. |
Transaction data | When you make payments through the Service, you provide financial account data, such as your card number, to our third-party service providers. We do not collect or store full card numbers, although we may receive card-related data and data about the transaction, including its date, time and amount and the type of payment method used. Where a subscription is purchased through the Apple App Store or Google Play, Apple or Google process the payment under their own terms and privacy policies, as independent controllers, and provide us with limited data about the transaction. |
Usage data | We record how you interact with our Service. For example, we log the features and content you interact with, how often and for how long you use the Service, which sections you use and other interactions. |
3. What we use your data for
We process your personal data for the purposes set out in the table below.
| Purpose | What this involves |
|---|---|
Running the Service for you | This includes enabling you to use the Service without interruption and preventing or addressing errors and technical issues. For example, we use your data to authenticate you and to authorise access to the Service. We use third-party AI providers, such as OpenAI and Google (Gemini), for the AI chat functionality within our Service. Chat data may be shared with them and retained by OpenAI for up to 30 days and by Google Gemini for up to 55 days, solely for security and misuse monitoring purposes. These providers do not use that data to train or improve AI models. They also apply security measures, including data encryption and audit controls, to protect data on their side. To provide personalised support and improve your experience with our AI assistant, we process general information about how you interact with the chat. This includes which features you access, such as chat refresh actions, popups viewed and responded to, prompt clicks and exit actions, and how frequently you use them, which helps us understand overall engagement patterns, including your feedback. |
Tailoring the Service to you | We select the payment processor available to you, and we may also use your data to determine your eligibility for promotions, sweepstakes and contests. |
Keeping your Memories | We store your Memory photos and captions in order to show them in your private album, create recaps at the end of a section or plan and sync them across your devices. We do not use Memory photos for advertising or marketing, to train AI models or for facial recognition, and we do not sell them or share them with third parties other than the service providers described in Section 6. |
Understanding how the Service is used | This helps us understand our business, analyse our operations and maintain, improve, plan, design and develop the Service and our new products. We conduct surveys and research and test features in development. We analyse the data we hold in order to evaluate the Service and carry out audits and troubleshooting to improve its content and layout. As a result, we often decide how to improve the Service on the basis of what this processing shows us. For example, if we find that users rarely open a particular section, we may focus on improving it. |
Inviting you to surveys | From time to time we may run surveys or ask for feedback for research purposes, and we may contact you to ask whether you would like to take part. Participation is optional. If you do not wish to be contacted about a survey or a marketing campaign, please write to us at support@roohy.com. If you would rather not contact us and simply do not want to take part, please ignore our messages. |
Taking payments and handling refunds | We provide paid products and services within the Service. For that purpose we use third-party payment processing services. As a result of this processing, you are able to pay for the paid features of the Service. We also process your data in order to handle refunds and to respond to chargebacks and other payment disputes, including by sharing the data necessary for that purpose with our payment processor. |
Staying in touch about your use of the Service | We may communicate with you by email or directly within the Service, including through push notifications. |
Helping you through support | As a result of this processing we send you messages about the availability of the Service, security, payment transactions, the status of your orders, legal notices and other Service-related information. When you contact support, your inquiry may be handled fully or partially by an AI assistant. Messages sent to our support team may be processed by the third-party AI providers described in Section 6. |
Sending you marketing | We process your personal data for our marketing campaigns and may add your email address to our marketing list. As a result, you receive information about our Service, its features, offers, promotions, contests and events, or other news and information about third-party services that may be of interest to you. You can opt out of advertising and commercial emails by contacting us at support@roohy.com. |
Showing you relevant ads | We and our partners use your personal data to tailor ads and to show them to you at a relevant time. |
Keeping the Service safe and resolving disputes | We use personal data to enforce our agreements and contractual commitments, to detect, prevent and combat fraud and other cybercrime, to take legally required action, and to make sure you are a real person and prevent the creation of fake accounts. As a result of such processing we may share your information with others, including law enforcement agencies, in particular where a dispute arises in connection with the Terms. |
Meeting our legal obligations | We may process, use or share your data where the law requires it, in particular where a law enforcement agency requests it by available legal means. |
4. What allows us to use your data (EEA and UK only)
This Section tells you which legal basis we rely on for each purpose of processing. For more detail on a particular purpose, please see Section 3. This Section applies only to users based in the EEA and the UK.

5. How long your data stays with us
Your personal data stays with us for as long as the purposes set out in this Policy require, and no longer, unless the law requires or allows us to keep it for a longer period.
A number of obligations require us to keep the data you give us: transactions have to be capable of being processed, settled, refunded or charged back; fraud has to be identifiable; and anti-money laundering rules and other laws binding on us and on our financial service providers have to be complied with. Because of that, disabling or deleting your Profile does not remove every record: we keep what those obligations require.
6. Who else sees your data
Third parties help us operate, provide, improve, integrate, customise, support and market the Service, and we share information with them for that reason. The sets of personal data involved depend on the purposes described in this Policy. Below you can see which categories of third party receive data from us.
6.1. Providers working on our behalf
Some third parties are engaged by us to perform services or business functions on our behalf and act on our instructions. The table below shows which categories of provider those are and what each of them receives.
| Category of recipient | What they do | Categories of data shared |
|---|---|---|
Cloud infrastructure and storage providers | Host and store data on our behalf, such as Google Cloud Platform | All categories of data described in Section 2, including Memory photos |
Data analytics providers | Help us analyse how the Service is used and detect issues | Usage and interaction data, browser and device data, advertising identifiers |
Marketing partners | Help us run, target and measure marketing campaigns and send marketing emails, such as Google Ads and Facebook Ads | Identifiers including email address, advertising identifiers, data about how you found us, usage and transaction data |
Communication service providers | Deliver emails, push notifications and messages, such as Zendesk | Identifiers, communications with us, usage data |
Support services providers | Help us handle support requests, such as EverHelp | Identifiers, communications with us, subscription and transaction data |
AI service providers | Enable the in-app chat and content-processing features, such as OpenAI | AI chat data and communications with us |
Gateway service providers and payment processors | Process payments and help prevent fraud, such as Solidgate | Identifiers, transaction data, browser and device data |
Memory photos go no further than our cloud infrastructure and storage providers, which hold them on our behalf. Analytics providers, marketing partners and AI service providers do not receive them.
6.2. Platform stores
Where a subscription is purchased through the Apple App Store or Google Play, Apple and Google process the payment, and the payment data you give them, as independent controllers under their own terms and privacy policies. They provide us with limited data about the transaction, as described in Section 2.2.
6.3. Requests from authorities
Personal data may be used and disclosed by us in order to enforce the Terms and to protect the rights, privacy, safety or property of the Company, of our affiliates, of you or of others. The same applies where we respond to a request from a court, a law enforcement agency, a regulator or another public or government authority, and in any other case provided for by law.
6.4. Corporate transactions
Assets and business offerings may be bought or sold as our business develops, and customer information is usually among the business assets transferred in a transaction of that kind. Information may likewise be shared with an affiliated entity, such as a parent company or a subsidiary, and transferred in the course of a corporate transaction, including a sale of our business, a divestiture, a merger, a consolidation or an asset sale, as well as in the unlikely event of bankruptcy.
7. Leaving the Service
Links to third-party websites, services and applications that we neither operate nor control may appear in the Service. The privacy practices of those third parties fall outside this Policy. A link is not an endorsement or an authorisation, nor does it represent that we are affiliated with the third party in question. Before you give personal information to any third-party service, or through it, please read that service’s own privacy policy.
Sharing Memories. Choosing to send a Memory photo to another app, such as a social network or a messenger, takes it out of the Service. From that moment the photo is governed by the privacy policy and the settings of that app, we no longer control it, and deleting the photo in the Service does not remove the copy you have shared.
8. Sending data across borders
Personal data may be transferred by us to a country other than the one in which it was first collected, so that we can provide the Service described in the Terms and pursue the purposes set out in this Policy. Where the receiving country does not offer the same data protection laws as the country in which you gave us the information, special safeguards are applied.
For a transfer of personal data originating in the EEA to a country whose level of data protection is not adequate, one of the following applies: (i) Standard Contractual Clauses approved by the European Commission, details of which are available here; (ii) the EU-U.S. Data Privacy Framework, details of which are available here; or (iii) an adequacy decision of the European Commission concerning the country in question, details of which are available here.
9. Updates to this Policy
This Policy may be updated from time to time so that it reflects changes in our practices. An updated version is then published within the Service, together with the date of the revision. Material changes may additionally be notified to you through the Service or by other means available to us.
We encourage you to check this Policy regularly so that you stay up to date.
10. Who may use the Service
The Service is meant for adults, and personal data is not knowingly collected by us directly from anyone under 18. If you use a kids plan, you may add photos of your child to the Memories feature; by doing so you confirm that you are the child’s parent or legal guardian. If you believe that a person under 18 has provided us with personal data directly, please contact us at support@roohy.com.
11. What you can ask us to do
The rights below exist so that you stay in control of your personal data.
Access, review and correction. You are entitled to obtain access to the personal data we hold about you, to have inaccurate data corrected and to have incomplete data completed. Your Profile is under your control, so Profile data can be viewed, corrected and updated at any time by logging in to the Service. A copy of the personal data collected during your use of the Service can be requested at support@roohy.com.
Deletion. Erasure of your personal data can be requested by writing to support@roohy.com, and Memory photos can be deleted directly in the app at any time. Reasonable efforts are made to honour a deletion request. Where the law requires certain data to be kept for a period of time, your request is fulfilled once those obligations have been met.
Objection and restriction. A request to stop using all or part of your personal data, or to limit how it is used, can be sent to support@roohy.com.
Withdrawal of consent. Where we process your personal data on the basis of your consent, for example for marketing communications or AI chat features, you can withdraw that consent at any time by writing to support@roohy.com. Withdrawal does not affect the lawfulness of processing carried out on the basis of consent before it was withdrawn.
Data portability. Should you wish to receive your personal data in a machine-readable format, write to support@roohy.com.
Complaint to a supervisory authority. We would prefer you to contact us first so that we can address your concerns. You nevertheless have the right to lodge a complaint with a competent data protection supervisory authority, in particular in the EU Member State where you live or work or where the alleged infringement took place. Our lead supervisory authority is the Office of the Commissioner for Personal Data Protection of Cyprus.
A request may also be submitted through an authorised agent. In that case the agent’s identity, your identity and the agent’s authority to act for you all have to be verified before the request can be processed.
12. If you live in the United States
State law may give you specific privacy rights, depending on where you live. The states concerned include, without limitation, California, Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah and Virginia, as well as any other state to the extent that it enacts privacy legislation. These rights apply only so far as the relevant state privacy law covers you and our processing of your personal data; their scope differs from state to state and legal conditions or exceptions may limit them. If it is not clear to you whether they apply, or you would like further clarification, write to support@roohy.com.
For California residents, this Section also serves as our California Notice at Collection.
12.1. What we collect and who receives it
The table below sets out the categories of personal information we collect and the categories of third party to which we disclose each of them. Section 2 describes the data itself in more detail and Section 6 describes the recipients. Some of the categories listed may qualify as sensitive personal information under applicable U.S. privacy laws.
| Categories of third-party recipient | Categories of personal information disclosed |
|---|---|
Cloud infrastructure and storage providers | All categories of personal information described in Section 2, including Memory photos |
Data analytics providers | Identifiers; internet or other electronic network activity; device data; commercial information |
Marketing partners | Identifiers, including email address; advertising identifiers; internet or other electronic network activity; commercial information |
Communication service providers | Identifiers; the content of your communications with us; internet or other electronic network activity |
Support services providers | Identifiers; the content of your communications with us; commercial information |
AI service providers | AI chat data; the content of your communications with us |
Gateway service providers and payment processors | Identifiers; commercial information; device data |
App stores, where a subscription is purchased through them | Identifiers; commercial information |
12.2. No penalty for using your rights
Exercising your privacy rights never exposes you to discrimination or retaliation. We will not refuse you services, apply a different price or provide a different level or quality of service because you have exercised any of those rights, save where applicable law permits it.
12.3. If we refuse your request
Where a privacy rights request of yours is refused, the decision can be appealed in states whose law grants that right, among them Colorado, Connecticut and Virginia. An appeal has to identify the original request and set out the grounds on which it is brought. Our response comes within the timeframe that applicable law prescribes. Should the appeal be refused as well, the matter can be escalated to your state’s Attorney General.
12.4. Turning off personalised ads
iOS: Settings, then Privacy, then Apple Advertising, then deselect Personalised Ads.
Android: Settings, then Privacy, then Ads, then enable “Opt out of Ads personalisation”. You can also reset your advertising identifier in the same section.
macOS: System Preferences, then Security & Privacy, then Privacy, then Apple Advertising, then deselect Personalised Ads.
Windows: Settings, then Privacy, then turn off “Let apps use advertising ID to make ads more interesting”.
Interest-based advertising can also be switched off through:
- the Network Advertising Initiative at optout.networkadvertising.org;
- the Digital Advertising Alliance (EU) at youronlinechoices.com.
12.5. “Shine the Light” requests
California residents may ask us for details of the information we have shared with third parties for electronic or online direct marketing purposes, where any such sharing has taken place. Those details are available once a year free of charge and cover the previous twelve (12) months.
A response follows within forty-five (45) days of the request, or we tell you that more time is needed. To make such a request, give us enough information for us to establish whether this applies to you, confirm that you are a California resident and supply a current California address to which we can reply. Requests are made in writing to support@roohy.com.
The first line of the description has to read “California privacy rights request”, and the request has to give your name, street address, city, state and ZIP code. Only one request per customer each year calls for a response from us, and requests sent by any route other than the address above do not. Information shared for purposes other than direct marketing is not necessarily covered by our response. Proof of identity may be requested and confirmed where we consider it necessary, at our sole discretion, and your request is kept for at least two years for auditing and user management purposes.
13. If you live in Brazil
Individuals in Brazil hold the rights listed below, which Article 18 of the General Personal Data Protection Law (“LGPD”) grants them: (1) confirmation that processing exists; (2) access to their personal data; (3) correction of incomplete, inaccurate or outdated data; (4) anonymisation, blocking or deletion of unnecessary or excessive data, or of data processed unlawfully; (5) portability of data to another service or product provider, on express request, in accordance with Brazilian regulations and subject to commercial and industrial secrecy; (6) deletion of personal data processed on the basis of consent, except in the cases provided for in Article 16 of the LGPD; (7) information about the public and private entities with which their personal data has been shared; (8) information about the possibility of refusing consent and the consequences of doing so; (9) revocation of consent, pursuant to Article 8(5) of the LGPD.
Requests to exercise these rights are sent to support@roohy.com. Full compliance is not always possible: a request may be manifestly unfounded or impractical, it may affect the rights of others, or the law may simply not require it. Even then a response follows, so that you learn what we have decided.
14. Cookies and similar technologies
What cookies are, how we and our providers use them and similar technologies in the Service, and how you can keep them under control are all explained below. Everything in this Section applies to our Website and to our application alike.
A cookie is a small text file sent to your browser or kept in the memory of your device. It usually carries the name of the domain it came from, how long it lives and a randomly generated identifier, and it may also record the settings you have chosen or what you did while using the Service.
Some cookies last only as long as your visit: session cookies disappear once you close the browser, and we rely on them so that the Service works properly within a single visit. Others stay on your device after the browser is closed. Those persistent cookies keep you signed in and serve analytical purposes.
Cookies also differ by who places them. First-party cookies come from us, for instance to remember the language of the interface. Third-party cookies come from the providers we work with and are outside our control; the privacy policy of the provider concerned governs them, so any question about such a cookie is best addressed to that provider directly.
Similar technologies. Alongside cookies, the Service keeps data in the local storage of your browser or device. Data of that kind remains on your device until you sign out, clear your browser data or delete the application. Inside our application, SDKs and advertising identifiers are used by us and by our partners.
What we group them into. Our use of cookies and similar technologies shifts as the Service develops, so we describe them by category:
- Necessary. Without these the Service does not work. They hold your cookie choices, stop forms from resetting and keep automated abuse out.
- Functional. These support features that are convenient rather than essential: the chat widget our support team uses, any video players embedded in the Service, and the preferences you have set, such as the language of the interface.
- Analytics. These reveal how the Service is used: which pages are opened, where people drop off and where visitors came from. Some tools go further and record clicks, taps and scrolling, which shows us where people get stuck.
- Advertising. These let us show you relevant ads, in the Service and elsewhere, and measure how our campaigns perform. Our advertising partners receive them.
Keeping cookies under control. Browser settings are the usual way to manage cookies, and most browsers offer them. Bear in mind that changing your cookie preferences may make the Service less convenient, and in some cases parts of it, or all of it, may stop being available to you.
Here is where each browser explains its own cookie settings:

15. “Do not track” signals
Save where this Policy states otherwise, “Do Not Track” requests are not supported by the Service. Whether any of the third-party services we use honour such requests is set out in their own privacy policies.
16. Getting in touch
Questions or concerns about this Policy, or about the way we collect, use or store your data, are always welcome at support@roohy.com.
